Please read these Terms and Conditions (hereafter "Terms" or "Terms and Conditions") carefully before using or purchasing from the formasigns.com website (hereafter "Site", “Website” or “the Website") or interacting with the purchasing system, customer support or other services (hereafter “the Service” or “Service”) operated by Forma Signs Ltd (hereafter "us", "we", or "our").

Your access to and use of the Website and Service is conditional on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and customers (hereafter “you”, “them”, or “they”) who:

*access the images, photos, audio, video and other forms of data or communication (hereafter “Content”); use the Service; and purchase store products, personalised or customised signs, lights, lamps or art (hereafter “Products”) from Forma Signs via the formasigns.com website, over the phone, email, in person or through any other means whether electronic, digital or otherwise.

By accessing or using the Website, Service, or by purchasing Products, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms then you may not access the Website or Service.

Eligibility

To be eligible to use this Website, you must be at least 18 years old. If you use formasigns.com on behalf of a company, entity, or organisation, you must be an authorised representative with the authority to bind it to these Terms and Conditions (which authority you hereby exercise).

Changes to these Terms and Conditions

We may modify the Terms and Conditions from time to time. When we make changes, we will notify you by making the revised version available on this webpage and indicating at the top of this page the date the revisions were last made. You should revisit these Terms and Conditions regularly, as revised versions will be binding on you. Any such modification will be effective when we post new Terms and Conditions. Your continued use of this Website after any posted modification to the Terms and Conditions indicates your acceptance of the modification.

Wholesale Terms and Conditions

These are the terms and conditions (the “Terms”) on which we, Forma Signs (“We”, “Us” and “Our”), produce and sell any of Our products (the “Products”) to you in your capacity as a retailer or wholesaler, whether you operate your business via a physical retail shop or e-commerce website.

We may ask you to prove the existence of your business for Us to establish that you are a retailer or wholesaler. This may include, amongst other things, your providing Us with the address or location of your business.

If We are unable to supply you with any Product(s) ordered, or if We are unable to comply with the time scale or volume set out in your Order, We will inform you of this by email as soon as is reasonably practicable upon becoming aware of any such issues. We will not process the Order unless and until you confirm to Us by email that you wish Us to proceed and the details of any changes required to be made to your order. If We are able to, We will offer you the nearest alternative or if you would prefer, We will refund you the total amount that you have paid in respect of the relevant Products as soon as is reasonably practicable, where you have already paid for the Products.

Once your order is received by Us, it will be added to Our workflow system list. We will confirm and accept your Order in writing by replying to your email and sending you an electronic copy of the invoice (the “Invoice”). The Invoice will confirm the details of your Order, an order number and the amount payable by you in respect of your Order, together with any delivery or other charges applicable to your Order.

Please read Forma Signs Terms carefully and ensure that you understand them and check that the details on your order for the Products and in these Terms are complete and accurate before you confirm you place an order for Products. You are responsible for all information provided to Us in relation to the products ordered. We shall not be responsible for any errors or missing information in the details We receive from you.

Website Availability

We reserve the right to modify, update, or discontinue formasigns.com at our sole discretion, at any time, for any or no reason, and without notice or liability.

Product Availability

All Forma Signs Products are made to order. We aim to deliver Your Product within 1-2 weeks for standard orders. We will make every effort to ensure your purchased product reaches you within the stated timeframe, but we make no guarantees, as issues can arise outside our control.

Product and Purchases

If you wish to purchase any product or make use of any Service made available through this Website, you may be asked to supply certain relevant information including, but not limited to, your name, email address, delivery address and payment information. Forma Signs reserves the right to change our prices at any time.

Forma Signs reserves the right to refuse or cancel specific orders at our sole discretion. We will inform you of any such refusal or cancellation within a reasonable timeframe and provide a reason.

We have made every effort to display the colours and images of our products as accurately as possible in our online store. We cannot guarantee that your computer monitor will display any colour accurately.

We reserve the right but are not obligated to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.

We reserve the right to limit the quantities of products or services we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion.

We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations or that any errors in the Service will be corrected.

Design Service

Where applicable, Forma Signs offers a design service for custom logos which are subject to a non-refundable £10 design fee per revision. Payment is required upfront and in full. If a customer approves the design(s) and proceeds with the sign purchase, Forma Signs will deduct (each) £10 design fee from the order total.

Forma Signs reserves the right to refuse certain design requests at our sole discretion. You will be informed of any such refusal within a reasonable timeframe, and a reason for the refusal will be provided.

Custom Quotes and Discounts

Unless otherwise stated, all custom quotes and discounts offered to customers are valid for 72 hours and may be subject to change thereafter.

Payment and Invoicing

Bespoke custom signs: Payment is required in full before production can begin. Once you have approved a design, you will receive an invoice via email, which can be paid via Paypal or a major credit card. Once payment is made, your Order will go into production.

Bespoke Custom signs are constructed entirely by hand; therefore, each sign is a 1-of-1 unique design made for the precise purpose and will of the buyer. Therefore, a custom neon sign may not 100% match the mock-up design we sent. Before shipping, customers will receive a design proof of their sign and will have 24 hours to review it and request minor adjustments, where possible and within reason. However, we cannot accept returns or exchanges after the customer approves the original mock-up and the order is paid. We encourage our customers to take as much time as they need before ordering their custom sign.

Please check the details set out in the Invoice, as We shall not be responsible for any errors or missing information once you confirm the Order. Please quote the Order number in all subsequent correspondence with Us relating to the Order.

Delivery

Standard and Rush delivery is completed upon the arrival of the Product at the Delivery Location. Delivery of the Product shall be accepted at any time of day.

Any dates quoted for Standard and Rush delivery are approximate only, and the delivery time is not of the essence. Forma Signs shall not be liable for any delay in delivery of the Product caused by a Force Majeure Event or the Customer's failure to provide Forma Signs with adequate delivery instructions, documents, licences or authorisations.

On delivery, the Customer shall thoroughly inspect the Product and shall not begin installation, engage any installers, or incur any further costs or expenses until it has done so.

Non Delivery

The quantity of any consignment of Product as recorded by Forma Signs upon dispatch from Forma Signs' place of manufacture shall be conclusive evidence of the quantity received by the Customer on delivery unless the Customer can provide conclusive evidence proving the contrary.

Forma Signs shall not be liable for any non-delivery of the Product unless written notice is given to the carrier and Forma Signs within 72 hours of the date when the Product would in the ordinary course of events have been received.

Any liability of Forma Signs for non-delivery of the Product shall be limited to replacing the Product within a reasonable time or issuing a credit note against any invoice raised for such Product.

Import Fees, Duties & Taxes

Orders to some countries may be subject to import fees/duties and taxes when delivery takes place. This depends on which country you are ordering from and how heavy the sign is.

Please note that this is standard procedure for any item bought online and is entirely out of our hands. Many orders won't be subject to import fees, but if they are, these fees are the customer's responsibility and are not covered by Forma Signs.

Once an order is confirmed, the customer is fully responsible for all postal charges, return shipment costs, and resend shipment costs if they refuse to accept a parcel due to import duties or taxes. Shipping costs are non-refundable. Delivery Standard excludes the day of posting and time spent on customs clearance.

Returns & Refunds

Forma Signs will accept returns and refunds of faulty Products only. We cannot accept returns due to a change of mind, as all our Standard, Personalised, and Custom-made signs are made to order and sent directly into production after payment is confirmed.

We decide the final resolution for faulty products, including refunds for the cost of the product and/or shipping, on a case-by-case basis at Forma Signs' sole discretion.

Customers must review their invoices carefully before paying to ensure the item's specifications are correct and to their satisfaction. Please flag any issues with your order immediately by contacting us at info@formasigns.com

Returns Procedure

Please get in touch with Forma Signs directly to let us know which product(s) you wish to return and why.

Please provide us with photos and videos of the item when you have received it for diagnostic and quality purposes. If you cannot provide both a video and photo(s) of the problem, then our ability to rectify your issue will be limited.
Once we have received all the required information, we will be in touch to resolve the issue. If a return has been agreed to, please note that the faulty product must be in its original condition that it was received, along with its original packaging, and sent to the return address provided by London Neon.
The faulty item must be returned for inspection by Forma Signs within 14 days of the date you received the product. Items sent after the 14-day window may no longer be refundable.
If a replacement has been agreed to, we will produce and ship the replacement product to you as soon as possible, free of charge.
We will process the refund immediately if a full or partial refund has been agreed upon.

Damaged in Transit

We recommend opening your Forma Signs parcel upon delivery. If your sign is damaged in transit, Forma Signs will ensure a resolution.

Damage must be reported within 72 hours of delivery of your sign to be eligible for a replacement. Damage or faults reported after this time period will follow our general returns and refunds policy and will not be covered under warranty. Note: the delivery date is the courier delivery date which can be found by following the prompts in your tracking email.

If you believe your item has been damaged in transit, please send an email to your info@formasigns with the following:

a clear photo of the damage to the sign,
a clear photo of the box & any damage to the outer box,
and a clear photo of the shipping label on the box.

Lost, Missing & Stolen Signs

Forma Signs takes all necessary care to ensure our signs are delivered safely to our customers. We use a premium express shipping service that requires a signature on delivery. The customer may request to opt-out of the signature on delivery directly through the shipping service once the shipment process has begun. Please be aware that if you choose to opt-out of the signature on the delivery requirement, Forma Signs will take no responsibility for lost, missing or stolen parcels marked as ‘delivered’ by the shipping service.

Warranty

All Forma Signs Products include a one-year warranty that covers electrical components when used appropriately, *unless otherwise stated.

Resolution for faulty signs will depend on the fault's source and will be determined between Forma Signs and You, the purchaser. Forma Signs will either fix, replace or refund the product.

Any neon sign that has been hardwired by an electrician automatically voids your purchase warranty, as it will be difficult for Forma Signs to establish a cause.

Rights

The content, trademarks, artwork and Products for sale on https://formasigns.com/ are the exclusive property of Forma Signs.

You acknowledge and agree that all ownership, license, intellectual property and other rights and interests in and to the Website and Service, including, without limitation, any sign designed and/or built-in connection with the Service, together with any image, design, proof or other representation or of a sign produced by Forma Signs in connection with the Service shall remain solely with Forma Signs, unless expressly agreed otherwise, in writing, by Forma Signs

You agree not to reproduce, duplicate, copy, or exploit any portion of the Product, use the Service or Products, or access to the Service or Products without express written permission from us.

As part of our Terms and Conditions, our customers warrant that they have appropriate intellectual property rights in any content they create or upload to our servers. Moreover, our customers agree to indemnify and hold harmless Forma Signs for all liability resulting from any breach of warranties, including the aforementioned intellectual property warranty.

Use of Formasigns.com

We permit you to use this Website subject to the restrictions in these Terms and Conditions.

Restrictions on Use

You agree that you will not and will not assist or enable others to:

*use formasigns.com to threaten, stalk, defraud, incite, harass, or advocate the harassment of another person, or otherwise interfere with another user's use of formasigns.com to submit or transmit spam, chain letters, contests, junk email, pyramid schemes, surveys, or other mass messaging, whether commercial in nature or not; use formasigns.com for promotional or commercial purposes, except as expressly allowed in writing by formasigns.com; use formasigns.com in a manner that may create a conflict of interest; use formasigns.com to promote bigotry or discrimination against protected classes; use formasigns.com to violate any third-party right, including any breach of confidence, copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; use formasigns.com to create or promote pornography or illegal content; use formasigns.com in violation of the Terms and Conditions or any applicable law; modify, adapt, appropriate, reproduce, distribute, translate, create derivative works or adaptations of, publicly display, sell, trade, or in any way exploit Forma Signs' Products or formasigns.com Content, except as expressly authorised by Forma Signs; reverse engineer any portion of formasigns.com, except as may be permitted under the law; remove or modify any copyright, trademark or other proprietary rights notice on formasigns.com or on any materials printed or copied off of formasigns.com; use any robot, spider, site search/retrieval application, or other automated device, process or means to access, retrieve, scrape, or index formasigns.com or any formasigns.com Content without permission from formasigns.com; reformat or frame any portion of formasigns.com; take any action that imposes, or may impose in our sole discretion, an unreasonable or disproportionately large load on formasigns.com technology infrastructure; attempt to gain unauthorized access to formasigns.com user accounts, computer systems or networks connected to formasigns.com through hacking, password mining or any other means; use formasigns.com or any formasigns.com Content to transmit any computer viruses, worms, defects, Trojan horses or other items of a destructive nature (collectively, "Viruses"); use any device, software or routine that interferes with the proper working of formasigns.com, or otherwise attempt to interfere with the proper working of formasigns.com; make excessive traffic demands; use formasigns.com to violate the security of any computer network, crack passwords or security encryption codes; disrupt or interfere with the security of, or otherwise cause harm to formasigns.com Content; remove, circumvent, disable, damage or otherwise interfere with any security-related features of formasigns.com features that prevent or restrict the use or copying of formasigns.com Content, or features that enforce limitations on the use of formasigns.com.

Third Parties

formasigns.com may include content from and/or links to other websites (each, a "Third Party Site"). We do not control or endorse any Third Party Site, and you agree that we are not responsible for the availability or contents of such Third Party Sites.

Miscellaneous

No agency, partnership, joint venture, or employment is created as a result of the Terms and Conditions, and you do not have any authority to bind us in any respect whatsoever.

We may provide you with notices, including changes to the Terms and Conditions, by email, regular mail or postings on formasigns.com.

The Terms and Conditions contain the entire agreement between you and us regarding the use of formasigns.com and supersede any prior agreement between you and us on the such subject matter. The parties acknowledge that no reliance is placed on any representation made but not expressly contained in these Terms and Conditions.

Any failure on our part to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder.

If any provision of the Terms and Conditions is unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms and Conditions shall otherwise remain in full force and effect and enforceable.

The Terms and Conditions are not assignable, transferable or sublicensable by you except with our prior written consent but may be assigned or transferred by us without restriction. Any assignment attempted to be made in violation of the Terms and Conditions shall be void.

The section titles in the Terms and Conditions are for convenience only and have no legal or contractual effect.
